Challenge:
Over the past several years, big money interests have realized how relatively easy it can be to influence the outcome of judicial elections in the states that elect their judges. Justice at Stake (JAS) believes that these expenditures threaten the principle of a fair and impartial judiciary and they wanted to learn which states offered the greatest potential for passing public financing laws for judicial elections. With limited resources, it was critical that JAS identify the optimal states in which to target their advocacy efforts.
Solution:
grassroots solutions conducted five comprehensive assessments to identify the potential for passing public financing. Working closely with JAS and their allies, grassroots solutions identified five key states to examine, and calling upon our firm’s extensive network of contacts, we developed a list of both in-state and national stakeholders to interview for each of the assessments. In-state visits were conducted to gauge a reading of the degree of interest in public financing for judicial elections in each state. Interviews were conducted with judges, legislators, legislative and executive branch staff, advocacy groups, and other stakeholders to represent a wide variety of viewpoints in the reports. These interviews were complimented by a review of the recent history of judicial elections, past efforts around public financing, and polling on the issue. This research led to the development of customized recommendations and basic campaign plans for each of the states.
Results:
- Needs assessments/feasibility studies, including a preliminary field plan were completed for five states—New Mexico, Wisconsin, Washington State, Montana and West Virginia—giving Justice at Stake and in-state and national stakeholders a clearer understanding of where allies and opponents stand on the issue in each of these states.
- As a result of efforts during the 2007 legislative session, New Mexico now has public financing for their judicial elections.
- Governor Jim Doyle of Wisconsin called a special session of the WI Legislature in December 2007 to specifically address public financing of elections. Public financing for state Supreme Court races received special attention when a separate hearing was scheduled to address a piece of proposed legislation that specifically looked at these elections.
- Justice at Stake now has the information needed to prioritize where they will concentrate their resources.
